Welcome to Automclaim. These Terms of Service ("Terms") govern your access to and use of the Automclaim platform and services ("Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Account Registration & Security

  • Eligibility: You must be an authorized representative of an automotive body shop or related business and of legal age to use the Service.
  • Account information: You agree to provide accurate, complete, and current registration information and to keep it updated.
  • Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • Notification: You must promptly notify us of any unauthorized use of your account.

3. Description of Service

Automclaim provides a subscription-based SaaS platform for automotive body shops that includes:

  • Integration with Gmail and Outlook email accounts
  • Monitoring and AI-powered analysis of insurance-related emails
  • Marketing email creation and delivery tools
  • Job management, invoicing, and financial tracking
  • Customer relationship management
  • Data insights and reporting

4. Subscriptions, Fees & Payment

  • Subscription plans: The Service is offered under subscription plans as described on our pricing page.
  • Auto-renewal: Subscriptions automatically renew unless cancelled before the renewal date.
  • Fees: All fees are quoted in US dollars and are exclusive of applicable taxes.
  • Refunds: Refund requests will be handled according to our refund policy, available upon request.
  • Changes: We reserve the right to change pricing with 30 days' advance notice.

5. Your Responsibilities

  • Lawful use: You agree to use the Service only for lawful business purposes and in compliance with all applicable laws and regulations.
  • Content ownership: You retain all rights to content you upload, transmit, or create through the Service. You grant us a limited license to use such content solely to provide and improve the Service.
  • Third-party compliance: When connecting Gmail or Outlook accounts, you must comply with Google's and Microsoft's applicable terms of service and privacy policies.
  • Anti-spam: You must comply with CAN-SPAM, GDPR, and all applicable anti-spam laws when sending marketing emails through the platform.

6. Prohibited Conduct

You may not:

  • Send unsolicited bulk email (spam) through the Service
  • Transmit malware, viruses, or other harmful code
  • Infringe on any intellectual property rights
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service for any illegal activity
  • Resell or redistribute the Service without authorization
  • Reverse engineer, decompile, or disassemble any part of the Service

7. Intellectual Property

All rights, title, and interest in and to the Service — including all software, text, graphics, logos, trademarks, and other materials — are and remain the property of Automclaim or its licensors. Nothing in these Terms grants you any right to use Automclaim's trademarks or branding without prior written consent.

8. Termination

  • By you: You may cancel your subscription and terminate your account at any time through your account settings or by contacting us.
  • By us: We may suspend or terminate your access if you violate these Terms, with or without notice depending on the severity of the violation.
  • Effect of termination: Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days after termination, after which it will be deleted.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOMCLAIM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Automclaim, its officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, or in the courts located in Los Angeles County, California.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be effective when posted on this page. We will update the "Effective Date" at the top and, for material changes, will provide notice through the Service or via email. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
